{"id":19086,"date":"2020-10-30T14:05:38","date_gmt":"2020-10-30T18:05:38","guid":{"rendered":"http:\/\/www.hivlegalnetwork.ca\/site\/?p=19086"},"modified":"2022-09-25T21:19:08","modified_gmt":"2022-09-26T01:19:08","slug":"news-release-jamaican-court-allows-tv-stations-to-censor-advertisement-urging-respect-for-lgbt-people","status":"publish","type":"news22","link":"https:\/\/www.hivlegalnetwork.ca\/site\/news-release-jamaican-court-allows-tv-stations-to-censor-advertisement-urging-respect-for-lgbt-people\/","title":{"rendered":"NEWS RELEASE: JAMAICAN COURT ALLOWS TV STATIONS TO CENSOR ADVERTISEMENT URGING RESPECT FOR LGBT PEOPLE"},"content":{"rendered":"&nbsp;<\/p>\n<div align=\"center\">\n<hr size=\"0\" width=\"100%\" align=\"center\" \/>\n<\/div>\n<h1 align=\"center\"><b>JAMAICAN COURT ALLOWS TV STATIONS TO CENSOR ADVERTISEMENT URGING RESPECT FOR LGBT PEOPLE <\/b><\/h1>\n<p><b><i>\u00a0<\/i><\/b><\/p>\n<p><b>October 30, 2020 \u2014 <\/b>Today the Jamaican Court of Appeal delivered its decision in a landmark case by Jamaican-Canadian attorney and human rights activist, Maurice Tomlinson, who is also an LGBTQ rights consultant with the HIV Legal Network. <span lang=\"EN-US\">The case, ongoing since 2012, challenged the refusal of national television stations to air \u201cLove &amp; Respect,\u201d a paid advertisement promoting respect for the human rights of LGBT people. <\/span><\/p>\n<p><span lang=\"EN-US\">It is the first appeal ever in Jamaica to raise the issue of human rights of LGBT people. It is also the first time the Court considered how the rights protected under the 2011 <\/span><i><span lang=\"EN-US\">Charter of Fundamental Rights and Freedoms <\/span><\/i><span lang=\"EN-US\">\u2014 in this case, freedom of expression, and the right to disseminate information and ideas via the media \u2014 <\/span><span lang=\"EN-US\">should apply against private corporations and not just the government.<\/span><\/p>\n<p><span lang=\"EN-US\">The Court affirmed, in theory, that Jamaica\u2019s <i>Charter<\/i> means that private parties (such as the TV stations named in this case) are obliged to respect constitutionally protected rights, but then declined to find that the TV stations had breached those rights. Tomlinson did not argue before the Court that the TV stations were obliged to run any paid advertisement submitted to them. Rather, he argued that the <i>Charter <\/i>means that a TV station could not refuse to air an ad on grounds that were arbitrary, discriminatory, or otherwise unreasonable.<\/span><\/p>\n<p><span lang=\"EN-US\">Sadly, the Court decided that the TV stations had acted acceptably in this instance, even though they openly acknowledged that they refused to air the advertisement because they claimed it could be viewed as endorsing criminal activity (i.e. same-sex sexual activity, which remains criminalized in Jamaica) and \u201ccould incite violence or breach of the peace.\u201d Perversely, the TV stations have been allowed to invoke the criminalization of LGBT people and anti-LGBT violence, both ongoing human rights violations in Jamaica, as a \u201cjustification\u201d for a discriminatory denial of freedom of expression of LGBT people. <\/span><\/p>\n<p>The tolerance ad, produced by AIDS-Free World, calls on Jamaicans to love and respect their LGBT family members. The Broadcasting Commission of Jamaica had previously confirmed it did not breach any of the country\u2019s broadcasting regulations or standards. The ad can be viewed <a href=\"https:\/\/youtu.be\/AZwCW1LREXk\">here<\/a>.<\/p>\n<p><span lang=\"EN-US\">While we are still reviewing the full decision, we are deeply disappointed that it is yet another instance of LGBT people being silenced by a justice system that is meant to protect the rights of all citizens. In this case, after years of litigation, justice for LGBT people has been both delayed and now denied outright.<\/span><span lang=\"EN-US\"><\/span><\/p>\n<p>This is a sad day for LGBT Jamaicans, their loved ones and allies. That claim was denied in late 2013 by the trial court, but Tomlinson chose to appeal that decision. In his appeal, Tomlinson is arguing that the Court failed to sufficiently consider the role of TV stations in a healthy democracy.
