{"id":26296,"date":"2026-09-29T15:16:20","date_gmt":"2026-09-29T19:16:20","guid":{"rendered":"https:\/\/www.hivlegalnetwork.ca\/site\/?post_type=news22&#038;p=26296"},"modified":"2026-09-29T15:33:32","modified_gmt":"2026-09-29T19:33:32","slug":"media-statement-a-welcome-decision-for-health-and-human-rights-in-canada","status":"publish","type":"news22","link":"https:\/\/www.hivlegalnetwork.ca\/site\/media-statement-a-welcome-decision-for-health-and-human-rights-in-canada\/","title":{"rendered":"MEDIA STATEMENT &#8211; A WELCOME DECISION FOR HEALTH AND HUMAN RIGHTS IN CANADA"},"content":{"rendered":"The HIV Legal Network is heartened by a British Columbia Supreme Court decision today that found section 5(2) of the <em>Controlled Drugs and Substances Act<\/em> (which prohibits possession for the purpose of trafficking) to be unconstitutional because it violates section 7 of the <em>Canadian Charter of Rights and Freedoms<\/em>. Section 7 guarantees the right to life, liberty, and security of the person \u2014 and this includes all people in Canada, including people who use drugs.<\/p>\n<p>In making her decision, which also dismissed the trafficking charges against Drug User Liberation Front (DULF) founders Jeremy Kalicum and Eris Nyx, Justice Catherine Murray\u00a0noted that Kalicum and Nyx had performed a public service at a \u201cconsiderable personal cost\u201d by operating a compassion club and overdose prevention site to save lives and supplying safety-tested substances to people who use drugs in the Vancouver area.<\/p>\n<p>This decision is an important legal step forward and an important affirmation of the human rights of all people who use drugs in Canada at a time when this country\u2019s toxic drug supply is killing thousands of people every year.
