Protecting Safe Consumption in Ontario

On Monday, April 7, all parties involved in the constitutional challenge brought forward by The Neighbourhood Group Community Services (TNGCS) and two individual Applicants will reconvene at the request of the Court.

On Friday, March 28, 2025, the Ontario Superior Court of Justice issued an injunction that enjoins Ontario from enforcing the rule prohibiting supervised consumption sites in Ontario from operating within 200 metres of a school of childcare centre until the Court decides on the constitutionality of the Community Care and Recovery Act. A constitutional challenge was heard in Ontario Superior Court in Toronto on Monday, March 24 and Tuesday, March 25, 2025. This challenge, brought forward by The Neighbourhood Group and two individual Applicants, will determine whether a number of life-saving supervised consumption sites (also known as Consumption and Treatment Services) in the province can continue to operate past the end of March 2025. The proceedings have concluded and the applicants are awaiting a decision.
